National Task Force to End Local Communist Armed Conflict (NTF-ELCAC)


Regarding the Proclamation of the 64th Party-List Seat


The National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) notes the recent decision of the Commission on Elections (COMELEC) to proclaim the Gabriela Women’s Party as the 64th party-list representative in the House of Representatives. While we acknowledge COMELEC’s mandate to ensure representation, this decision raises serious constitutional and procedural concerns that warrant careful scrutiny.


The Constitution explicitly caps party-list representation at twenty percent (20%) of the total membership of the House of Representatives. With 317 members in the 20th Congress, the maximum number of party-list seats is constitutionally limited to 63. The creation of a 64th seat—regardless of intent—appears to exceed this constitutional boundary. We urge COMELEC to clarify how this decision aligns with the fundamental law it is sworn to uphold, as exceeding established limits risks eroding institutional integrity.


Our concern is compounded by the specific beneficiary of this decision. Gabriela Women’s Party remains the subject of a pending disqualification case filed before COMELEC in 2019.


NTF-ELCAC firmly supports the right of all sectors, including women, to genuine representation. However, awarding a House seat under these circumstances—while a disqualification case remains pending and constitutional limits are stretched—risks undermining public trust.


We call upon COMELEC to reaffirm its sacred duty as guardian of our electoral and democratic processes. Decisions of this gravity must be anchored in unambiguous constitutional adherence and thorough vetting of all candidates, especially those with unresolved serious allegations. The Filipino people deserve institutions that prioritize the rule of law, national security, and the untainted integrity of our democracy.
